These Terms of Service and Sale (the Terms) apply when you use orbitmuse.shop (the Site) or buy products from Orbit Muse Nail Studio. Please read them before placing an order.

These Terms do not limit any rights you have under UK consumer law. If you are a consumer, your legal rights include rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the Consumer Rights Act 2015.

For orders delivered to the European Union, any mandatory consumer protections in the country of delivery also apply. Nothing in these Terms limits those rights.

2. When these Terms apply

By placing an order through the Site, you agree that these Terms will apply to that order. You must be legally able to enter into a contract and provide complete and accurate contact, billing and delivery information.

Our Shipping & Delivery Policy, Returns & Refunds Policy and Privacy Policy also apply. Nothing in those policies or these Terms excludes or restricts your statutory rights. If there is an inconsistency, these Terms apply unless the other policy gives you greater rights.

3. Our products

Each Orbit Muse Nail Studio set contains 10 press-on nails in the fixed size you select (XS, S or M), liquid glue, adhesive tabs, a nail file, a wooden stick and an alcohol wipe.

The nails are reusable when they are applied, removed and cared for properly. Reusability, fit and results depend on preparation, application, activity, removal and care. We do not promise a particular wear period unless one is expressly stated on the relevant product page.

We take reasonable care to describe and display our products accurately. Images are illustrative, and colours may look slightly different on different screens or in different lighting. This does not affect your right to receive goods that match their description.

Products are subject to availability. We will not substitute a materially different product without your agreement.

4. Size and fit

Our sets are offered only in the fixed sizes XS, S and M. Please use the Size Guide and check your measurements before ordering. Natural nail shapes and measurements vary, so a size label cannot guarantee an exact fit for every nail.

Selecting XS, S or M does not make a set personalised or made to order. If you choose the wrong size, your statutory cancellation rights and our Returns & Refunds Policy still apply.

5. Placing an order and when the contract is formed

The products shown on the Site are an invitation to place an order.

When you submit an order, you make an offer to buy the products in your basket. Please check and correct any errors before submitting it.

An automatic order acknowledgement confirms that we received your order; it does not mean that we have accepted it.

We accept your order, and a contract is formed, when we send a dispatch confirmation or dispatch the products, whichever happens first.

The contract is concluded in English. You can save or print these Terms, and we will send order and dispatch information in a form you can keep.

Before acceptance, we may decline an order if a product is unavailable, we cannot authorise payment, we cannot deliver to the address, a price or description error is clear, the order appears fraudulent, or a reasonable purchase limit has been exceeded. If we have taken payment for an order we do not accept, we will refund it promptly to the original payment method.

6. Prices, delivery charges and payment

Prices are shown in pounds sterling (GBP). They include any taxes that apply to the sale where required. Delivery charges are shown separately before you place the order.

You must pay using one of the payment methods offered at checkout. By submitting payment details, you confirm that you are authorised to use that method. Payment may be authorised or collected when you place the order.

If we discover an obvious pricing error before accepting your order, we will contact you and give you the option to order at the correct price or cancel. Promotions are subject to any specific terms shown with the offer and must be applied before checkout is completed.

7. Delivery

Our current delivery options are:

Standard delivery: £4.99, with an estimated delivery time of 3–5 business days.
Free standard delivery: available when the eligible order value is £50 or more, as calculated at checkout.
Express delivery: £6.99, with an estimated delivery time of 1–2 business days.

EU standard delivery: £14.99, with an estimated delivery time of 3–5 business days to the European Union destinations available at checkout.

In these Terms, a business day means Monday to Friday, excluding public holidays in the part of the UK relevant to the delivery.

The delivery method, price and estimated timeframe that apply to your order will be displayed at checkout and confirmed after purchase. UK prices include 20% VAT where applicable. For EU orders, any applicable taxes, duties or customs charges are shown at checkout where Shopify can calculate them; otherwise, local authorities or the carrier may request payment before delivery. Estimated delivery dates are not guaranteed unless we expressly agree a guaranteed date with you.

Unless we agree otherwise, we will deliver without undue delay and no later than 30 days after the contract is formed. If delivery is delayed, your rights may include choosing a reasonable new deadline or ending the contract, depending on the circumstances and whether delivery by a particular date was essential.

Please provide a complete and accurate delivery address. Contact us as soon as possible if you notice an error. We cannot promise that an address can be changed after dispatch, but this does not affect responsibility for delivery where the law places it on us.

The products remain at our risk until they come into the physical possession of you, or a person you identify to receive them. If you independently arrange a carrier that we did not offer, risk passes when we hand the products to that carrier. Ownership passes to you once we have received payment in full.

8. Your right to cancel an online order

If you are a consumer, you normally have the right to cancel an online order without giving a reason. The cancellation period starts when the contract is formed and ends 14 days after the day on which you, or a person you nominate other than the carrier, receives the goods. If one order is delivered in separate parcels on different days, the period ends 14 days after the last parcel is received.

To cancel, email support@orbitmuse.shop before the cancellation period expires. Your message must clearly state that you wish to cancel and should include your name, order number, delivery address and the products concerned. You may use the model cancellation form at the end of these Terms, but you do not have to.

If you cancel before dispatch, we will stop the order where reasonably possible and refund all payments for the cancelled products. If the products have already been dispatched or delivered, follow our return instructions.

9. Change-of-mind returns and refunds

After telling us that you are cancelling, you must send the products back within 14 days. Please contact us for return instructions before posting anything. For a change-of-mind return, you are responsible for the direct cost of returning the products unless we agree otherwise. We recommend keeping proof of posting.

You may inspect the products as you would reasonably be allowed to do in a shop. We may reduce the refund to reflect any loss in value caused by handling beyond what is necessary to establish the products' nature, characteristics and functioning. This does not affect your rights if the products are faulty, damaged, incorrect or not as described.

We will refund payments due to you, including the cost of our least expensive standard UK delivery method, within 14 days after the earliest of:

the day we receive the returned products; or
the day you provide evidence that you sent them back.

If you chose a more expensive delivery method, we do not have to refund the extra amount above the standard delivery cost. We will use the original payment method unless you expressly agree otherwise, and we will not charge a refund fee.

10. Faulty, damaged, incorrect or misdescribed products

We have a legal duty to supply goods that are of satisfactory quality, fit for any purpose you made known to us before purchase, and as described. Your legal remedies may include the short-term right to reject goods within 30 days, or rights to a repair, replacement, price reduction or final rejection, depending on the circumstances. Products bought in a sale have the same statutory rights as full-price products.

If a product arrives damaged, is incorrect, develops a fault or does not match its description, email support@orbitmuse.shop with your order number and a description of the issue. We may ask for reasonable evidence, such as photographs where appropriate, but this will not be used to unfairly prevent you from exercising your rights.

Where the law requires us to accept a faulty, damaged, incorrect or misdescribed product, we will cover reasonable return costs and provide the remedy required by law. Damage caused by misuse, accidental damage, normal wear, or failure to follow supplied application, removal or care instructions is not a product fault, although this does not limit rights you may still have.

11. Application, care and safety

Read and follow all application, removal, care and safety instructions supplied with the set and shown on the relevant product packaging. Liquid nail glue is an adhesive: avoid accidental contact with skin and eyes and follow its packaging instructions and warnings. Keep the set and its components out of the reach of children.

Do not use a product contrary to its supplied warnings. If you have concerns about allergies, sensitivity, or the health of your nails or surrounding skin, seek appropriate professional advice before use. Stop using the product if you experience an adverse reaction and seek appropriate advice where needed.

Nothing in this section excludes responsibility for a defective or unsafe product or limits your statutory rights.

12. Using the Site

You may use the Site only for lawful purposes. You must not misuse it, attempt unauthorised access, interfere with its operation, introduce malicious code, or use automated means to extract substantial parts of the Site without permission.

We may suspend access where reasonably necessary for security, maintenance or legal compliance. We do not guarantee that the Site will always be available, but a Site interruption does not affect a contract we have already accepted or your rights in relation to an order.

The Site may contain links to third-party websites or services. We are not responsible for third-party content or separate purchases you make from a third party. This does not affect our responsibility for services we choose to use to fulfil your Orbit Muse Nail Studio order.

13. Intellectual property

The Site and its text, photographs, graphics, branding, design and other content are owned by or licensed to Orbit Muse Nail Studio, unless stated otherwise. You may view and use the Site for your personal, non-commercial shopping use. You must not reproduce, sell, publish, modify or commercially exploit our content without prior written permission, except where the law allows.

14. Privacy

We handle personal information as explained in our Privacy Policy. That policy explains what information we collect, why we use it, who we share it with and the rights available to you.

15. Our responsibility to you

We are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. Loss or damage is foreseeable if it was obvious that it would happen or if both you and we knew it might happen when the contract was formed.

We supply products for private, domestic use. If you use them for a commercial or business purpose, we are not responsible for business losses such as loss of profit, revenue, contracts, opportunity, data or goodwill, except where the law does not allow that exclusion.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, a defective product where liability cannot legally be excluded, breach of your statutory rights, or anything else that cannot lawfully be excluded or limited.

16. Events outside our reasonable control

We are not responsible for delay caused by an event outside our reasonable control. We will take reasonable steps to reduce the effect of the delay and will contact you where appropriate. If there is a substantial delay, you may contact us to end the contract and receive a refund for products you have paid for but not received, subject to your legal rights.

17. Changes to these Terms

We may update these Terms to reflect changes to our products, Site, business practices or the law. The Terms in force when your order is accepted will apply to that order. A later update will not retrospectively change an existing contract unless the law requires it or you agree.

18. General legal terms

If any part of these Terms is found to be unlawful or unenforceable, the remaining parts will continue in effect. If we do not enforce a right immediately, that does not mean we have waived it. No person other than you and Orbit Muse Nail Studio has a right to enforce the contract between us.

19. Complaints

If you have a concern or complaint, please email support@orbitmuse.shop. Include your order number where relevant so we can investigate. This does not prevent you from using any other remedy available to you.

20. Governing law and courts

These Terms and contracts made through the Site are governed by the laws of England and Wales. If you live in Scotland or Northern Ireland, you also retain the benefit of any mandatory protections given to you by the law of that part of the UK.

You may bring legal proceedings in the courts of the part of the UK where you live. We may bring legal proceedings against you only in the courts of the part of the UK where you live, except where consumer law permits otherwise.
